Samsung Galaxy S III DeniedIf you're eager to put your hands on the newest Samsung Galaxy S III device, you may be bummed to hear Apple wants to stop you. Apple is seeking an injunction to halt sales of the smartphone in the U.S., alleging the phone infringes on two of its patents. Apple is asking the court to add the S III to its existing preliminary injunction motion for the Galaxy Nexus, says Fosspatents. The iPhone maker is suing Samsung over two software patents that seem to be related to Siri. Samsung calls its smartphone voice recognition software S-Voice. Samsung responded by saying that Apple should be required to file a new motion for Galaxy S III. In an email statement to CNET, Samsung says it will demonstrate that its phone is "innovative and distinctive:"
If Apple wishes to seek an injunction against the Galaxy S III, the Court should require Apple to file a new motion and allow the parties to develop a full factual record on all four factors. Accordingly, the Court should reject Apple’s motion to amend its current notice of motion for a preliminary injunction. Samsung believes Apple's request is without merit. We will vigorously oppose the request and demonstrate to the court that the Galaxy S III is innovative and distinctive. We would also like to assure consumers that the U.S. launch and sales of the Galaxy S III will proceed as planned. The Galaxy S III has already been highly received in markets where it has been introduced. Samsung looks forward to bringing the Galaxy S III to the U.S., and we believe that Apple's actions would only serve to disrupt consumers' access to the latest innovative mobile technology.
Apple talked with CNET through their spokesperson:
It's no coincidence that Samsung's latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging, This kind of blatant copying is wrong, and we need to protect Apple's intellectual property when companies steal our ideas.
Meanwhile, in the U.S. Samsung's Galaxy S III preorders have started and BGR says that Verizon Wireless will make the phone available on July 9th.
